Michael J. Antongiovanni, Esq. recently obtained a preliminary injunction on behalf of a corporate client against a former employee, who perpetrated a fraudulent “lapping” scheme while employed by the company and continued the scheme after the termination of her employment. Lapping is a type of fraudulent misappropriation of company funds whereby, for instance, an employee misappropriates customer payments and then hides the theft by diverting payments from other customers to offset the stolen funds. In granting the motion, the Court found that the injunction is necessary to prevent irreparable harm to the client’s good will, reputation and customer relationships.
